Well I could always fill in the "changed details" part on the V5 before it goes into the MOT, then send it away after, least that way they know I intended to update the details.

Actually looking at my V5 it does not state the number of seats in the "number of seats, including driver" section

Also checked on the vosa website, MOT check and it doesn't come up with anything regarding number of seats, I'll still change it anyway just so it is registered with them.
